Accessing the Web site

The Site and all information and materials on the Site have been prepared for access and use by persons in the Republic of Seychelles only. If you are accessing the Site from outside the Republic of Seychelles, you do so at your own risk and you are solely responsible for compliance with local laws. Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable if for any reason our Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our Site, or our entire Site, to users who have registered with us.

If you choose, or you are provided with, a Username, Password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third-party. We have the right to disable any Username or Password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Service. When using our Site, you must comply with the provisions of our acceptable use policy as described below. You are responsible for making all arrangements necessary for you to have access to our Site. Sudoku.co.za is not be obligated to refund all or any portion of any Account fee (if any), by reason of any interruption of the services by reason of any of the circumstances described herein.

Account Registration

Accounts ("Account" or "Accounts") as used herein is defined as the account that results from registering for any service with sudoku.co.za. When you complete a registration process, you create an Account and you become a Registered User ("Registered User"). Your Account allows you to participate in specific services on sudoku.co.za. To create an Account, you must enter your name, an email address, Username and Password. Your Username is your sudoku.co.za identity. You may not select a Username that is used by someone else, and your Username cannot be indecent, or otherwise offensive, or be used in any way that violates the Terms of Service. You may not provide false information during the registration process. You must provide truthful and accurate information in creating your Account. sudoku.co.za requires all users to be 13 years of age or older.

Registration does not place you under any obligation to purchase any of our products, services or information. We reserves the right to limit the number of Accounts a user can establish. This limit may change over time at our discretion.

You are solely responsible for all activity on your Account and for the security of your computer system. You should not reveal your Password to other users. We will not ask you to reveal your Password. If you forget your Password, you can request to have a new Password sent to your registered email address. You agree to indemnify and hold us harmless for any improper or illegal use of your Account by you. This includes illegal or improper use by someone to whom you have given permission to use your Account or whom you have negligently allowed to access your Account. Your Account is at risk if you let someone use it inappropriately and your Account in any of our services is subject to termination if you, or anyone using your Account, violates our Terms of Service.

Acceptable use Policy

You may use our Site only for lawful purposes. You may not use our Site in any way that breaches any applicable local, national or international law or regulation; in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; for the purpose of harming or attempting to harm minors in any way; to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards as described below; to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

Interactive Services

Where we do provide any interactive services, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical). We will do our best to assess any possible risks for users and in particular, for children from third-parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our Site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards whether the service is moderated or not.

Content Standards

These content standards apply to any and all material (“Contribution”) which you contribute to our Site, and to any interactive services associated with it. Contributions must not: contain any material which is defamatory of any person; contain any material which is obscene, offensive, hateful or inflammatory; promote sexually explicit material; promote violence; promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; infringe any copyright, database right or trade mark of any other person; be likely to deceive any person; be made in breach of any legal duty owed to a third-party, such as a contractual duty or a duty of confidence; promote any illegal activity; be threatening, abuse or invade another?s privacy, or cause annoyance, inconvenience or needless anxiety; be likely to harass, upset, embarrass, alarm or annoy any other person; be used to impersonate any person, or to misrepresent your identity or affiliation with any person; give the impression that they emanate from us, if this is not the case; advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Sudoku.co.za may prohibit you from participating in competitions and contests, if at the sole discretion of us, you show a disregard for these terms and conditions and/or the official rules for any game and/or if you act in an unsportsmanlike manner; with an intent to annoy, abuse, threaten, or harass any other player; or in any other disruptive manner.

Suspension and Termination

Sudoku.co.za and you both have the right to terminate or cancel any Account at any time for any reason. You may not transfer any of your rights or delegate any of your obligations under this agreement without our prior written consent. If we fail to enforce any provision of this User Agreement, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion. Nothing in this agreement shall confer on any third party any benefit or the right to enforce any term of the agreement.

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our Site. When a breach of this policy has occurred, we may take such action as we deem appropriate. Failure to comply with this acceptable use policy constitutes a material breach of the Terms of Service upon which you are permitted to use our Site, and may result in our taking all or any of the following actions: immediate, temporary or permanent withdrawal of your right to use our site; immediate, temporary or permanent removal of any posting or material uploaded by you to our site; issue of a warning to you; legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; further legal action against you; disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Your Username may be deactivated if you do not use it within six months after the date that it was created or for any continuous period of six months after creation. If you do not use your Username for six or more months, it may be removed and deleted by the Web site administrator at their sole discretion. We will use reasonable efforts to notify you by email before we delete your Username. In the event of deactivation, your Username will be permanently deleted, along with your Username records, ranks and service information.

Transactions through our Site

Contracts for the supply of products, services or information formed through our Site or as a result of visits made by you are governed by our User Agreement. Any applicable fees and other charges are payable in advance and not refundable in whole or in part. Sudoku.co.za may, from time to time, modify, amend, or supplement its fee and billing methods, and post those changes on the Web site. Such modifications, amendments or supplements shall be effective immediately upon posting on the Web site. If any change is unacceptable to you, you may cancel your Account at any time, but sduoku.co.za will not refund any fees that may have accrued to your Account before such cancellation, and we will not pro-rate fees for any charges.

The Padlock Symbol

Sudoku.co.za contains a shopping area where you can purchase products and services online. The shopping area is a secure site and is certificated as secure for financial transactions. The padlock symbol will be visible at the bottom of your screen whilst you are in the secure site.

Material Submitted by you

Whenever you make use of a feature that allows you to upload material to our Site, or to make contact with other users of our Site, you must comply with the content standards set out in our acceptable use policy as described above. You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty.

Any material you upload to our Site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third-parties any such material for any purpose. We also have the right to disclose your identity to any third-party who is claiming that any material posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

General

If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This Agreement shall be governed in accordance with laws of the Republic of Seychelles for any action or proceeding arising under or by reason of this Agreement.

Refund Policy

Since Sudoku.co.za provides non-tangible irrevocable services we do not issue refunds once the order is accomplished. As a customer you are responsible for understanding this upon purchasing any item at our site.

Players

Please choose carefully before you purchase any of our game credit bundles. We do not give refunds if you simply change your mind or make a wrong decision. Visitors, meaning non-registered users, can play one Level 3 (Medium) and one Level 4 (Difficult) and one Level 5 (Cruel) Sudoku puzzles via our free “Puzzle of the Day” feature. This feature allows any visitor the opportunity to evaluate (similar to a free trial) whether the games we offer are a match for their level of skill.

A Visitor may then complete our easy webform to become a Registered User, who will have, in addition to a Visitor, access to a whole lot more features, all of which cost nothing. This concession allows the Registered User an additional opportunity to make an informed decision. Buying is therefore considered an intentional act. Also, if you delete your account for any reason or if your account is terminated for any reason, you will not be entitled to any refund.

Advertisers

Please choose carefully before you purchase any of our advertising services. We do not normally give refunds if you simply change your mind or make a wrong decision. We would, however, consider an upgrade in case the service was wrongly described (something which we go the great lengths to prevent in the first place). You may browse our Website anonymously to see how and where we offer advertising space and you may also register as a user, once again without obligation, to browse and discover more advertising opportunities. We offer various means for Advertisers to monitor the placement of their advertisements.

Fair Trade

Sudoku.co.za has every incentive to keep customers happy by providing quality products, services and technical support. At times, we may reverse a sale in order to comply with credit card industry rules, ACH industry rules, Google terms of service, PayPal terms of service, and requests from verified judiciary or law enforcement agents.

Visitor

You can visit our Web site and use many of our services without having to tell us who you are or reveal any Personally Identifiable Information to us. There are, however, a few instances where we do collect Personally Identifiable Information in order to meet your request. We use a number of methods (such as cookies, clear gifs and statistics from Awstats, Alexa and Google Analytics) for traffic and response measurement. Advertisers require information regarding ad impressions and click-through rates, and by providing them with this information, we are able to offer free content to our visitors. In all cases, the only information we will ever disclose to third parties (eg advertisers, partners, affiliates) is aggregate information about our users. Aggregate information only identifies the user population in general terms eg 64% of our visitors are from USA, it will never identify individual users.

Registered user (same as visitor plus the following)

In order to enjoy additional benefits from this Web site, you have to register. During registration you are required to give contact information (such as name and email address). We use this information to create an Account for you on our Site and later to contact you about the services on our Site in which you have expressed interest. Based upon the Personally Identifiable Information you provide us, we will send you an activation email. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your Account. We will communicate with you by email, in accordance with your wishes.

You have the option to provide your demographic information (such as gender, country, age and interests) once your Account has been activated. Daily Free Sudoku Emails

This is our equivalent to a normal newsletter. Emails are sent from our list server so that you can always recognise the sender. Please make sure you don't have email filters that will mistake our newsletter as spam. As a suggestion, add our email address (puzzles@sudoku.co.za) to your address book. Daily Free Sudoku Emails are sent to users who has shown a desire to receive them. You are offered the opportunity to subscribe during registration. However, if you didn't check the box during registration, then you can still do so afterwards. Log in with your username and password and change your preferences at any time. Subscription to our newsletter is optional, free and only available to Registered Users and Paid Subscribers. It is easy to subscribe and it is equally easy to unsubscribe. Neither actions affect your Account in any other way.

Out of respect for your privacy, we provide you with three ways to opt-out (unsubscribe). You can remove yourself from our newsletter by simply following the "Unsubscribe" directions included in each newsletter. Secondly, you can activate/deactivate the subscription via user functions on our Site. And finally, if all else fails, you can Contact us via the webform for assistance.

Sudoku Alerts

We may send you service-related announcements occasionally. For instance, if our service is temporarily suspended for maintenance, or security announcements, or if we've made a material change to our Privacy Statement, or if your Account if about to be deleted, then we may contact you. You cannot unsubscribe from these communications which are not promotional in nature. If you do not wish to receive them, you have the option to delete your Account.

Tell-A-Friend

If you choose to use our referral service to tell a friend about our Site, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. Sudoku.co.za stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us via the webform to be removed from our database.

Access to Personally Identifiable Information

If your Personally Identifiable Information changes you may update it by making the changes directly on our Web site. This is obtained before users are added to our mailing list. Our emails are valuable to the recipient and therefore also to the sender.
